1. Scope #

These Website Terms govern access to and use of the Instant Record Check website and its publicly available information. They are for website visitors and readers. Separate Applicant Terms govern use of the portal to request or complete a criminal record check.

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site. Mandatory consumer-protection and other rights that cannot lawfully be waived are not excluded or limited by these Terms.

2. Privacy and separate consents #

The Privacy Policy describes how Instant Record Check collects, uses, discloses, and retains personal information. It does not make browsing the Site blanket consent to every processing purpose. Consent for a criminal record check, identity verification, optional result sharing, marketing communications, and other purposes is obtained separately where required. Your browser settings may restrict cookies, but they are not a substitute for any consent control that applicable law requires.

3. Ownership and intellectual property rights #

Instant Record Check and its licensors own or control the Site and its contents, including text, graphics, logos, software, and other materials, except for third-party materials identified as such. Nothing in these Terms grants you rights in the Site except the limited right to access it for its intended informational purpose.

You may not modify, copy, reproduce, republish, upload, post, transmit, or distribute Site content without permission. You may print or download reasonable portions solely for your own non-commercial use if you do not alter or remove copyright or proprietary notices. A communication you send to Instant Record Check does not give you a claim against it for alleged infringement or misappropriation of rights in that communication, except to the extent applicable law provides otherwise.

4. Use of the Site #

You must use the Site lawfully and must not interfere with its operation, attempt unauthorized access, introduce malicious code, or use content to mislead others. Information, products, or services clearly identified as supplied by Instant Record Check are supplied by it or its agents. Other information, products, services, and linked materials may be supplied by independent third parties. Instant Record Check does not control or endorse third-party materials and does not guarantee that files available for download will be free of viruses or other harmful code.

5. Disclaimers and limitation of liability #

The Site and related information are provided on an “as is” and “as available” basis. To the extent permitted by law, Instant Record Check makes no express or implied warranty or representation about title, non-infringement, merchantability, fitness for a particular purpose, availability, accuracy, completeness, or usefulness of the Site or third-party material. You are responsible for evaluating information before relying on it.

To the extent permitted by law, Instant Record Check is not liable for indirect, incidental, consequential, punitive, special, exemplary, or other similar damages, or for loss of profits, revenue, salary, reputation, programs, information, or business interruption, arising from use of or inability to use the Site, its information, transactions, or delays. Nothing in this section excludes liability or a remedy that cannot lawfully be excluded or limited, including mandatory consumer rights.

6. Indemnification and third-party rights #

To the extent permitted by law, you agree to indemnify and hold harmless Instant Record Check, its officers, directors, employees, agents, licensors, suppliers, and third-party information providers from losses, expenses, damages, costs, and reasonable legal fees resulting from your breach of these Terms or negligent or wrongful conduct in using the Site.

The provisions concerning use, disclaimers, limitation of liability, and indemnification are intended for the benefit of those persons and entities and may be enforced by them where applicable law permits.

7. Term and termination #

Instant Record Check may suspend or terminate access to the Site, and you may stop using it, subject to applicable law. The provisions concerning intellectual property, use, disclaimers, limitation of liability, indemnification, third-party rights, and miscellaneous matters survive termination to the extent their nature requires.

8. Miscellaneous #

Instant Record Check may update these Terms by posting a revised version on the Site. You should review them periodically. Continued use after a change constitutes acceptance only to the extent permitted by law. These Terms and policies expressly incorporated into them describe the agreement concerning Site use; they do not replace the separate Applicant Terms or create an organization service agreement.

These Terms are governed by the laws of British Columbia and the applicable laws of Canada, subject to any mandatory law or forum that applies to you. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. No waiver is effective unless made by the party entitled to give it.
